More than a year after the collapse of Bashar al-Assad\u2019s regime, most of these issues remain unresolved, amid differing approaches between Damascus and Beirut on how to address them in a way that preserves sovereignty, legal rights, and human rights standards.<\/span><\/p>\n<h2 style=\"text-align: justify;\"><b>The Syrian Detainees File<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Following the fall of Assad\u2019s regime in early December 2024, the issue of Syrian detainees held in Lebanese prisons resurfaced prominently. Since then, the Syrian transitional government and Lebanese authorities have exchanged visits and held multiple meetings in an attempt to resolve the file. Despite repeated statements suggesting an imminent breakthrough and international calls to close the issue, no final agreement has been reached.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Last week, <\/span><a href=\"https:\/\/aawsat.com\/%D8%A7%D9%84%D8%B9%D8%A7%D9%84%D9%85-%D8%A7%D9%84%D8%B9%D8%B1%D8%A8%D9%8A\/%D8%A7%D9%84%D9%85%D8%B4%D8%B1%D9%82-%D8%A7%D9%84%D8%B9%D8%B1%D8%A8%D9%8A\/5218429-%D9%81%D8%B4%D9%84-%D8%A7%D9%84%D8%AA%D9%88%D8%B5%D9%84-%D9%84%D8%A2%D9%84%D9%8A%D8%A9-%D8%AA%D8%B3%D9%84%D9%8A%D9%85-%D8%A7%D9%84%D8%B3%D8%AC%D9%86%D8%A7%D8%A1-%D8%A7%D9%84%D8%B3%D9%88%D8%B1%D9%8A%D9%8A%D9%86-%D9%81%D9%8A-%D9%84%D8%A8%D9%86%D8%A7%D9%86-%D8%A5%D9%84%D9%89-%D8%AF%D9%85%D8%B4%D9%82\"><span style=\"font-weight: 400;\">Asharq Al-Awsat<\/span><\/a><span style=\"font-weight: 400;\"> quoted Lebanese sources saying that a visit by a Lebanese judicial delegation to Damascus failed to produce tangible results toward a new judicial treaty regulating the transfer of Syrian detainees from Lebanon. The sources noted significant differences in how both sides approached the proposed agreement, with Damascus rejecting most of its provisions for failing to meet its minimum demands regarding the repatriation of Syrian prisoners.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">According to the sources, Lebanon has shown cooperation and understands Syria\u2019s desire to complete trials or enforce sentences on its own territory. However, the proposed agreement applied only to convicted prisoners and excluded detainees still on trial, as transferring the latter would require legislation from the Lebanese parliament; currently not feasible.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A Syrian source described the draft agreement as \u201cbooby-trapped,\u201d revealing deep disputes over two key clauses. The first would allow the transferring state (Lebanon) to refuse handing over any detainee or convict without justification \u2013 something Damascus viewed as granting Lebanon unchecked authority to block transfers. He also noted that the detainees and missing persons files \u2013 particularly those dating back to the Assad era \u2013 cannot remain open indefinitely.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">He added that the United States could play a role in resolving outstanding issues, given its growing influence following recent geopolitical shifts in the Middle East.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Another pressing issue is the presence of former Syrian regime officers who fled to Lebanon.
